With regard to the organization and history of the company formerly known as “BHJKennedy’s company unattached cavalry,” I respectfully state the following statement of facts. When this company first reported to your Regt. It was commanded by 1st Lt. D. O. Anderson, Capt. Kennedy having refused as I was informed because of infirm health and advanced age. Lt. Anderson declining promotion, an election for Capt. Was ordered by Lt. Genl Polk at which I was elected Captain of the company, being myself at that time a member of Capt. William’s company of your Regt. The muster roll of Kennedy company showed that it was mustered in the Confederate Service for three years by Maj. Cox, _______ing and _____picking officers. It was composed at the time of muster as I was informed by Lt. Anderson of non-conscripts and exempts and reported to Genl __illow as a supporting force to the “Conscript Beckons(?)” on which duty it remained until ordered to you by Lt. Genl Polk. Of my own personal knowledge since taking command of H company I know that most of the men present are conscripts and exempts. Some have been absent without leave of whom I know nothing but there have been a minimum present at muster. Lt. Anderson being now absent his certificate of facts stated cannot be secured. Some of those lately killed in action and among the few at home I did not know to be conscripts. Having answered your inquiries to the best of knowledge,
